Terms of Service
Last updated: 2026-05-17 · Governed by the laws of the Republic of Ghana
Template notice. This document is provided as a starting point. Before publication, have it reviewed by qualified legal counsel licensed in Ghana.
1. Your agreement with us
These Terms govern your use of the LTX MoMo Insurance service ("the Service"), including the customer portal, the USSD channel, and any related cover certificates. By enrolling, you accept these Terms and the Privacy Policy. The insurance contract itself is between you (the policyholder) and Activa International Insurance Ghana Ltd. (the insurer).
2. Eligibility
- You must be at least 18 years old and resident in Ghana.
- You must hold a verifiable Ghana Card.
- You must own and operate the MTN MoMo wallet linked to the policy.
- Cover cannot be issued to persons on applicable sanctions lists; matches are reviewed manually and may be denied.
3. Cover, premiums, and renewal
- Cover starts on the day the first monthly premium is successfully debited from your MoMo wallet and continues so long as subsequent premiums are paid.
- Premium amounts are fixed at enrolment per the selected plan and disclosed in your certificate.
- If a debit fails, your policy enters a grace period (default 7 days). Cover continues during grace; if no successful debit occurs by the end of grace, the policy lapses.
- A lapsed policy can be reinstated by paying the outstanding premium, subject to underwriter discretion.
- We may change premium rates with at least 30 days' notice; the change applies on your next renewal date.
4. Claims
- File a claim within 30 days of the incident through the app, USSD
*123#, WhatsApp, or an authorised agent.
- Provide all reasonable evidence we request (transaction logs, police report for theft, screenshots, etc.).
- We aim to action new claims within 72 hours and pay approved claims within 48–72 hours of approval into your MoMo wallet.
- Claims above GHS 5,000 require dual-underwriter approval.
- Cover is capped per claim at the limits printed on your certificate.
5. Fraud and misuse
Any of the following voids cover and may be reported to the police and the NIC's industry fraud register:
- Providing false or altered evidence at enrolment or in support of a claim.
- Using another person's Ghana Card or MoMo wallet.
- Self-inflicting loss to trigger a payout.
- Repeated abuse of the customer-support or USSD channels for harassment.
6. Cancellation and refunds
- You can cancel any time from the portal — cover ends on the day of cancellation and you will not be billed again.
- No refund is due for the current billing month once cover has been provided. Mid-month cancellation does not pro-rata the current premium.
- We may cancel cover with 14 days' written notice for non-payment, fraud, or sanctions hit.
7. Use of the MTN MoMo wallet
- You authorise us to debit the agreed premium each month from the wallet you registered.
- You authorise us to credit approved claim payouts into the same wallet.
- Wallet PIN, OTPs, and SIM control remain entirely your responsibility — we never ask for your PIN.
8. Limits and disclaimers
The Service is provided "as available". We are not liable for losses caused by:
- MTN network outages, SIM-swap fraud beyond cover limits, or third-party platform downtime.
- Indirect, consequential, or punitive damages.
- Anything outside the cover scope expressly listed in your certificate.
Nothing in these Terms limits liability for personal injury caused by our negligence, fraud, or any liability that cannot be limited under Ghanaian law.
9. Disputes and governing law
These Terms are governed by the laws of the Republic of Ghana. Disputes are subject to the exclusive jurisdiction of the courts of Accra, save that you may always escalate complaints to the National Insurance Commission (nicgh.org) or the CHRAJ for human-rights-related matters.
Before going to court, please raise the dispute through our internal complaints process: File a complaint.
10. Changes to these terms
We may update these Terms from time to time. Material changes will be announced at least 30 days in advance via email and the in-app notification centre. Continued use of the Service after the effective date constitutes acceptance.
